White House accuses Moonshot AI of building Kimi K3 by distilling Anthropic's Claude
AI model theft just went federal: the White House says China’s hottest AI model is a copy of Claude.
The accusation
On July 22, 2026, White House OSTP Director Michael Kratsios stated that Moonshot AI built Kimi K3, its 2.8 trillion parameter model, by running large-scale distillation against Anthropic’s Fable 5, using an internal platform that switched between access methods to avoid detection.
Kratsios also said Moonshot tapped export-restricted Nvidia GB300 chips through servers in Thailand. The U.S. Treasury has floated sanctions and Entity List designations in response, which would move the dispute from rhetoric into enforcement.
The evidence, as presented
The receipts, according to the U.S. side, come in two parts. Anthropic earlier reported over 3.4 million Claude exchanges generated through fraudulent accounts. And independent analysis by researcher Ryan Greenblatt found that K3 identifies itself as Claude far more often than chance would explain, the kind of fingerprint that distillation from a teacher model can leave behind.
The pushback
The counterargument starts with a calendar problem. Fable 5 only became publicly available on July 1, and K3 shipped on July 16. Experts interviewed by TechCrunch doubt 15 days is enough to distill a frontier model this way, and Moonshot denies wrongdoing.
That timeline gap is the strongest card the skeptics hold. Distillation at the scale alleged is not a weekend job, and if the technical claim does not survive scrutiny, the political one gets harder to sustain. On the other hand, the fraudulent-account figures predate the Fable 5 launch window, which leaves room for a longer-running operation than the 15-day framing suggests. The public evidence does not yet settle it either way.
What happens next
K3’s open weights are still promised for July 27, now with a provenance cloud hanging over them. Anyone who builds on those weights inherits the question of what they were trained on, and any Entity List action would reshape who can legally touch them.
